Data Cap Plan Terms & Conditions

$20 off your monthly access fee offer is available to approved new and recontracting Optus Mobile Broadband customers signing up to a Data Cap $59.95/$79.95, Data Cap Plus $59.95/$79.95, My iPad $59.95/$79.95 or Data Cap Plus Voice $69.95/$89.95 plans for 12 month, 24 month or month-to-month between 15/07/11 to 07/04/2012. A $20 credit will be applied to your account each month while you remain connected and if you have signed up to a contract (12/24 month plan), you will receive the full credit by the completion of your contract. The credit will appear on your account from the second bill. The credit is not transferable and is not redeemable for cash. Offer may be withdrawn at anytime. Not available in conjunction with any other offer.

Optus Mobile Broadband (OMB) coverage area is device dependant. With dual band devices coverage is available throughout The Optus Open Network™ in 3G dual band areas, subject to network availability.  Not available for sale in NT or TAS (except Hobart). ‘yes’ Coverage Commitment applies. The Optus Mobile Broadband service is supplied in accordance with the terms of the Optus Mobile Broadband Standard Form of Agreement and Acceptable Usage Policy. Optus Mobile Broadband plans may only be used as a data plan unless otherwise specified. You must comply with these terms including our Acceptable Use Policy (Appendix H) when using the service. You should not use the supplied SIM to access (and may not be able to access) other services such as voice calls, International voice calls, Voice Mail, International SMS, premium and Third Party SMS, MMS, International MMS, 1300, 19XX. If you are able to access such services, your use of such services will be charged at prevailing rates. Optus supplies these services to you on the terms of Optus’ Standard Form of Agreement (the Agreement). The Agreement is made up of your application, the consumer terms and the service descriptions, standard pricing tables and the any relevant appendices and contains full details of the service and the terms and conditions of supply of each service including charging, billing, terms and cancellation. Copies of all documents that make up your Agreement (excluding your application) are available on the Optus website at optus.com.au/standardagreements. Services are only available with monthly billing. International data usage is not included in your data limit. Additional charges apply and may be varied without notice. Refer to optus.com.au/roamingpartners. Data usage will be counted in kilobytes and includes both uploads and downloads. Walled Garden: If you exceed your plan’s included value, your service will be restricted and you will only be able to access specified unmetered web pages (currently only Facebook, Twitter, eBay, LinkedIn, Foursquare, MySpace myZOO, Optus webmail websites) until your next billing period commences or you purchase a data block with additional included value. A list of unmetered web pages is available at http://memberservices.optuszoo.com.au. If you have exceeded your plan’s included value, the unmetered web pages may not display full content due to restrictions on accessing 3rd party content. Data Block: You may purchase at any time in the billing month up to 4 additional data blocks per month. Data Blocks provide additional included value for use only within the billing month they are purchased. Included value expires at the end of the billing month. Any unused value does not rollover, is not transferable, is not redeemable for cash or refundable. All applicants are subject to Optus credit assessment and acceptance. Offer available to new eligible and recontracting OMB customers until withdrawn. General: Offer cannot be combined with any other offers or bundled reward unless stated. Software Requirements: You must meet the minimum system requirements as per the Mobile Broadband device packaging to connect to the service. Subject to your rights under the Competition & Consumer Act, Optus does not make any warranty regarding the software or data provided to you as it operates on your computer and interacts with your other applications. OMB application shows approximate usage only. Paper invoice fee: Online billing will be phased in over time and may not be available to you immediately. If we have advised you that online billing is available to you and you still choose to have a paper bill posted to you, you will be charged a paper invoice fee of $2.20. If online billing is not available to you, we won’t charge you the fee. Optus will advise you of the availability of online billing before any fee is charged. For further information please see optus.com.au/aboutmyaccount. Credit card fee: If you use a credit or charge card to pay your bill, a 1% fee (inc.GST) will be charged. This payment processing fee will be shown on your Optus bill after the payment has been processed. Exemptions may apply. Single bill: Optus may place one or more of your services that you have with Optus on a single bill. At point of sale you may choose to have all services billed individually. If you receive a single bill, afterwards it may not be possible to obtain individual bills for your services. Direct Debit fee: A $2.20 per month fee applies if your account is not paid by direct debit. Non payment of a bill may result in the suspension or disconnection of the Services. ‘yes’ Coverage Commitment (YCC): If coverage is not to your satisfaction, you will need to contact us within 7 days of activation to cancel your service. No cancellation fees will apply. You will only be charged for your usage, pro-rated access fee and device charges if applicable. You will need to return the device at your own cost. Optus will send you a letter instructing you on how to return the device, which you must return within 14 days of issue date of the letter to avoid equipment charges. For InZone and Voicebox, YCC applies to your nominated address only. YCC is available until withdrawn. Faulty devices are not covered by this YCC. Cancellation fees apply outside the YCC period. Cancellation Fees Mobile Broadband Data Cap Plus plans: If you cancel your service before the end of the agreed contract terms you may incur a cancellation fee; on a Mobile Broadband Data Cap Plus $29.95 plan on a 24 month contract: 0-12 months a fixed cancellation fee of $899.00, 13-15 months 80% ($719.20), 16-18 months 60% ($539.40), 19-21 months 40% ($359.60), and 22-24 months 20% ($179.80) of the cancellation fee plus any remaining device repayments if applicable; on a Mobile Broadband  Data Cap Plus $29.95 on a 12 month contract: 0-6 months a fixed cancellation fee of $899.00, 7-9 months 70% ($629.30), 10-12 months 40% ($359.60), of the cancellation fee plus any remaining device repayments if applicable; on a Mobile Broadband Data Cap Plus $39.95 plan on a 24 month contract: 0-12 months a fixed cancellation fee of $999.00, 13-15 months 80% ($799.20), 16-18 months 60% ($599.40), 19-21 months 40% ($399.60), and 22-24 months 20% ($199.80) of the cancellation fee plus any remaining device repayments if applicable; on a Mobile Broadband  Data Cap Plus $39.95 on a 12 month contract: 0-6 months a fixed cancellation fee of $899.00, 7-9 months 70% ($699.30), 10-12 months 40% ($399.60), of the cancellation fee plus any remaining device repayments if applicable; on a Mobile Broadband Data Cap Plus $59.95 plan on a 24 month contract: 0-12 months a fixed cancellation fee of $1099.00, 13-15 months 80% ($879.20), 16-18 months 60% ($659.40), 19-21 months 40% ($439.60), and 22-24 months 20% ($219.80) of the cancellation fee plus any remaining device repayments if applicable; on a Mobile Broadband  Data Cap Plus $59.95 on a 12 month contract: 0-6 months a fixed cancellation fee of $899.00, 7-9 months 70% ($769.3), 10-12 months 40% ($439.60), of the cancellation fee plus any remaining device repayments if applicable; on a Mobile Broadband Data Cap Plus $79.95 plan on a 24 month contract: 0-12 months a fixed cancellation fee of $1199.00, 13-15 months 80% ($959.20), 16-18 months 60% ($719.40), 19-21 months 40% ($479.60), and 22-24 months 20% ($239.80) of the cancellation fee plus any remaining device repayments if applicable; on a Mobile Broadband  Data Cap Plus $79.95 on a 12 month contract: 0-6 months a fixed cancellation fee of $899.00, 7-9 months 70% ($839.50), 10-12 months 40% ($479.60), of the cancellation fee plus any remaining device repayments if applicable. Mobile Broadband Data Cap Plans on a 12 month contract: If you cancel your service before the end of the agreed contract terms you may incur a cancellation fee; on a Mobile Broadband Data Cap $4.95 on a 12 month contract: 0-6 months a fixed cancellation fee of $20, 7-8 months 60% ($12), 9-10 months 40% ($8), 11-12 months 20% ($4), of the cancellation fee plus any remaining device repayments if applicable; on a Mobile Broadband Data Cap $19.95, $29.95, $39.95, $59.95 and $79.95 plans on a 12 month contract: 0-6 months a fixed cancellation fee of $150, 7-8 months 60% ($90), 9-10 months 40% ($60), 11-12 months 20% ($30), of the cancellation fee plus any remaining device repayments if applicable.
