You are entering into a legal agreement between you and IPrimus you confirm that you are the account holder and will buy internet and home phone services from us on the following terms and conditions. You agree to the IPrimus Core terms and service schedules, which can be found on our standard form of agreement page, and IPrimus acceptable use policy as they apply to the service. A critical information summary for the service is also available on our website. A copy of these documents will be sent to you with your welcome pack.
Your plan includes a telephone service if you provide us your existing telephone number, you agree that this number will be transferred to us as part of your new connection. Your telephone service will be provided via the internet and requires a continuous power supply. We do not provide a battery backup option and your telephone service will not operate and you will not be able to make emergency calls in the event of a power outage. Any services that rely on the internet will also be affected. You should have a charged mobile phone available to make calls in an emergency. Your service is strictly for residential use, IPrimus does not offer priority assistance.
If you or a member of your household has a life threatening medical condition which requires priority assistance, this service may not be suitable for you. This also includes back to base alarms or medical alert systems. Telstra is an alternative provider of priority assistance. All call rates not expressly included in your plan are charged at applicable rights. Included values expire at the end of the billing period and are not refundable or transferable, call rates are available on our website. Waiver of customer service guarantee, IPrimus is asking you to waive the rights you have under the telecommunications customer service guarantee standard 2011.
This standard contains requirements for connection times fault repairs and appointments. financial compensation is provided based on the number of days delayed beyond the applicable service level. If you agree to this waiver, all guaranteed service levels will not apply. You will forgo your right to monetary damages for delays in connecting your telephone service for any fault repairs and for delays in making changing or amending appointments, you are under no obligation to agree to the waiver. However, if you do not agree we are unable to offer you the telephone service. This waiver will commence on the date that you signed this agreement and is granted to Primus telecommunications Proprietary Limited. Nothing in this waiver limits any consumer rights you may have under the Australian Consumer Law.
Your plan also includes an internet service. The type of service offered may be either NBN Opticomm, or red train network. Depending on which network your addresses service by an NBN Opticomm or red trained technician may be needed to install hardware and cabling at your address to activate your service. If required, you authorize us to book the technician and proceed with this work. A person over the age of 18 will need to be present at the premises during installation.
Please note that NBN Opticomm and red train charge fees for first time connection in new developments, installation of additional equipment or non standard connections, connection fees and additional charges are available on our website. The speeds you experience on your service may be affected by many factors including the technology receive your location and equipment and the level of internet traffic More information is available on our website. If you are connected on fibre to the node fibre to the basement or fiber to the curb, we will confirm your line speeds once you are connected to your service. If you cannot get speeds close to your chosen speed tier we will let you know and can then move on to another one without any extra fees. If you are connected on fixed wireless speeds experienced may be significantly impacted by congestion during busy times. The effect of these factors on your service cannot be confirmed until after it is activated.
A Wi Fi modem is included with all IPrimus plans with a total cost of $180 IPrimus will cover the cost of your modem if you stay connected for 18 months, but you will repay remaining amounts if you cancel your service within the first 18 months repayment period. The modem may be refurbished, is not locked IPrimus and is yours to keep.
Details about paying for your service, receiving bills and price changes are available on iPrimus’ website and your welcome pack. IPrimus internet and home phone services are supplied as a bundle and cannot be separated. If you break the bundle you may lose all services and early termination fees may apply.
The service is provided for the address you provided us if you relocate, we may not be able to provide you with the same offer and relocation or cancellation charges may apply. If your service is canceled within five days of scheduled installation, some costs may still be payable. This can include the setup fee, any remaining hardware repayments and past the reconnection fees from our partner network providers. Details are available on our website. It is your responsibility to check the terms of any existing contract you may have with your existing service provider as an early termination fee may apply to your existing service.
